PURCHASE AGREEMENT/CONTRACT

PLEASE READ ALL OF THIS CONTRACT BEFORE INITIALING EACH SECTION AND SIGNING. 


The puppy’s tail will be docked and dew claws removed by a licensed veterinarian at the appropriate age under the care of the Seller/Breeder; therefore, the puppy will have its tail docked and dew claws removed at the time of transfer to the buyer.  The puppy will be examined by a licensed veterinarian before transfer.  The Seller/Breeder will supply the buyer with pertinent medical information pertaining to the puppy at time of transfer.  The buyer is required to have the puppy examined by a licensed veterinarian within 3 (three) business days/ 72 (seventy-two) business hours from the date/time of pickup; failure to have puppy examined by a licensed veterinarian within 3 (three) business days/72 (seventy-two) business hours from the date/time of pickup will void the one-year health guarantee as defined in this purchase agreement/contract.

The Seller/Breeder guarantees that the puppy is healthy and free of all communicable diseases to the best of my knowledge.  After transfer of ownership from the Seller/Breeder to the buyer and the puppy leaves Seller/Breeder’s premises, the Seller/Breeder will no longer be responsible for the life, health, or well-being of the puppy.  The Seller/Breeder will not be responsible or reimburse buyer for any vet bills incurred after transfer of ownership of the puppy to the buyer.

All vaccinations and wormings are performed by the Seller/Breeder and/or by a licensed veterinarian.  At the time of transfer of ownership this puppy will have received all the age appropriate vaccinations and will have been wormed multiple times.  It is the responsibility of the buyer to continue the puppy’s care and to contact a licensed veterinarian immediately if the puppy is not eating and/or drinking properly or has any type of issue(s) once the puppy is in the buyer’s care.  Buyer’s initials __________ 


The buyer will not give or allow anyone else to give this puppy any vaccinations within 2 (two) weeks from the last date that vaccines were administered by the Seller/Breeder, not including rabies.  Many vaccines are not fully effective until the complete series of vaccinations have been completed which can take weeks to months to complete.  The Seller/Breeder advises the buyer to keep the puppy out of public areas that other dogs/puppies are known to visit frequently as the puppy can still contract diseases and parasites in these types of places.

This purchase agreement/contract does not cover hips/joints/elbows/skeletal issues/cartilage issues of any kind, allergies, reproductive organs, any puppy diseases, virus, parasite, protozoa or any other type of illness or infestation. Seller/Breeder is not responsible for any stress the puppy endures during the move to its new home.  Seller/Breeder is not responsible for illness or infection related to environmentally created disorders such as, but not limited to, kennel cough, pneumonia, hypoglycemia, coccidiosis, giardia, parasites, mites and other autoimmune disorders.  Seller/Breeder is not responsible for nonlife-threatening genetic defects such as, but not limited to, umbilical or inguinal hernias, undescended testicles and under/overbite.

This purchase agreement/contract includes a one-year health guarantee that covers only LIFE-THREATENING GENETIC HEALTH ISSUES that may be found by the licensed veterinarian of the buyer’s choice. The puppy must be taken to the veterinarian of the buyer’s choice within 3 (three) business days/72 (seventy-two) hours from date of pick up or this one-year health guarantee will become NULL and VOID. If life-threatening genetic health issue(s) are found, the buyer will provide the Seller/Breeder with a statement from the licensed veterinarian stating the findings for the Seller/Breeder to review.  After the Seller/Breeder reviews the statement, the Seller/Breeder will have the Seller/Breeder’s veterinarian review the statement to determine if the issue(s) is/are indeed a life-threatening genetic health issue(s). If the findings are shown to be a life-threatening genetic health issue(s) then a REPLACEMENT puppy will be given as a replacement and the original puppy must be returned to the Seller/Breeder.  NO CASH WILL BE GIVEN AS A REPLACEMENT.

If the puppy dies prior to one year from the signed date on this purchase agreement/contract, a necropsy must be performed and the results sent to the Seller/Breeder within 7 (seven) business days by email or priority mail. If the necropsy does not show that the puppy in this purchase agreement/contract died from a life-threatening genetic health issue(s) then no replacement puppy will be provided and no cash will be returned.

The buyer must be certain that the buyer can provide proper care for this puppy, be a responsible Doberman puppy owner, and have a Doberman (puppy or adult) in the buyer’s home/place of residence prior to signing this purchase agreement/contract.  For example, the landlord is aware and approves of the Doberman puppy on the property and in the home, no allergies of household members, prepared for the energy level of a Doberman, etc.

If for any reason this puppy does not work out with the buyer or a situation occurs that would displace this puppy, the Seller/Breeder must be notified immediately upon knowledge of the displacement situation. The puppy can be returned to the Seller/Breeder at any time with no questions asked by Seller/Breeder; however, no cash refunds will be provided.  At the time of puppy’s return, the buyer will fill out and sign all necessary paperwork transferring ownership of the puppy/adult Doberman back to the Seller/Breeder. The buyer will not sale and/or rehome the puppy without the Seller/Breeder’s knowledge and permission.  The Seller/Breeder understands that life situations change and wants what is best for the puppy/dog and by no means wants a puppy bred by the Seller/Breeder to end up in a situation with the possibility of being euthanized. This puppy is not to be given to an Animal Control Shelter/Pound, any other Humane Organization, or any puppy/dog rehoming business/organization without the buyer first offering the puppy back to the breeder at NO COST, REGARDLESS OF AGE. Any puppy bred by the Seller/Breeder always has a home back with the Seller/Breeder.

The exact adult size and adult weight cannot be guaranteed by the Seller/Breeder.  The Seller/Breeder can only make an educated guess based upon the parent’s physical characteristics and personality. All puppies are sold as pet/companion quality and are not guaranteed to be show or breeding quality unless otherwise specified in this contract.

The buyer agrees to not have this puppy spayed/neutered before 18 (eighteen) months of age and not after 24 (twenty-four) months of age. This one-year health guarantee shall become NULL AND VOID if this puppy/dog is spayed or neutered before 18 (eighteen) months of age.  The buyer is responsible for providing the Seller/Breeder of proof of spay/neuter at appropriate age.  Early sterilization can be detrimental to the physical and mental growth of young dogs by causing growth issues and increasing the risk of behavioral issues.

All registration paperwork will be supplied at pick up; however, if for some reason registration paperwork is not available at the time of ownership transfer/pick up, it will be received within 90 (ninety) days from the date that the contract is signed.

Failure of the buyer to pick up the puppy and have the puppy paid in full by 8 (eight) weeks of age, the buyer will forfeit any payments and rights the buyer had to purchase the puppy in this purchase agreement/contract or any other puppies.  The Seller/Breeder reserves the right to cancel this sale/purchase of puppy in this purchase agreement/contract at any time up until the time of transfer of the puppy to buyer for any reason the Seller/Breeder feels is appropriate.

LIMITED REGISTRATION/PET PURPOSE ONLY (  ) 

The puppy is purchased on a limited (non-breeding rights) AKC registration.

The Seller/Breeder has determined that the puppy in this purchase agreement/contract is purchased as a pet and will not be bred.  The buyer agrees to neuter/spay the puppy no earlier than 18 (eighteen) and no later than 24 (twenty-four) months of age. If the buyer fails to spay/neuter the above puppy within the above time frame then the buyer agrees to pay a $3,000.00 (three thousand dollars) for breach of contract, plus any and all fees, including, but not limited to legal fees, court costs, veterinary examinations, etc. incurred by the Seller/Breeder to enforce this contract. Puppy/dog ownership will return back to the Seller/Breeder if the puppy/dog is found to not be spayed/neutered by 24 (twenty-four) months of age and the buyer will not receive a refund of any kind.  At the time of puppy/adult Doberman return, the buyer will fill out and sign all necessary paperwork transferring ownership of the puppy/adult Doberman back to the Seller/Breeder.

Transfer of ownership to anyone other than the original buyer(s) or original buyer(s) involved in a co-ownership or housing of this puppy/dog anywhere other than the buyer’s residence does not limit or in any way change the responsibility of the above named buyer to spay/neuter the animal as per this purchase agreement/contract.

The Seller/Breeder deems said puppy from above whelping as having potential for breeding. Breeder/Seller states that said female dog shall not be bred until 20 (twenty) months of age or second heat.  Breeder/Seller states that said male dog shall not be bred until 15 (fifteen) months of age.
